Republican and Democratic Nominees Confirmed to the EEOC

Republican nominees Andrea Lucas and Keith Sonderling were confirmed as Commissioners to the Equal Employment Opportunity Commission (EEOC) in Senate votes Tuesday, solidifying Republican control of the Commission into 2022.

All five Commissioner seats have been filled for the first time during the Trump administration, as Democratic nominee Jocelyn Samuels was also confirmed this week. Samuels is the Executive Director of the Williams Institute, a UCLA think tank focused on sexual orientation and gender identity policy. 

Significant practical labor and employment law experience:  Lucas has spent the last decade as a management-side attorney in Gibson Dunn’s labor and employment practice, with a focus on sexual harassment and discrimination litigation.  Sonderling has served as the Deputy and Acting Administrator of the Wage and Hour Division at the Department of Labor during the current administration.  “Both nominees have considerable experience as labor and employment practitioners in both the private and public sector,” said HR Policy Senior Labor and Employment Counsel Roger King. 

Outlook:  The confirmation of all three nominees gives the Trump administration its first full complement of EEOC commissioners and solidifies a Republican majority on the Commission through at least July 2022, regardless of the outcome of the November elections.  The Republican majority will play a large role in shaping three key policy areas currently under consideration at the Commission: increasing voluntary resolution of discrimination charges through mediation and conciliation programs; the collection of workforce pay data; and regulation of company wellness programs.
